DISCLAIMER NOTICE TO MEMBERS AND  VISITORS (TRAVELERS) TO

Welcome to Global Home Exchange and Global Pacific Vacation Homes.  By using or accessing any of our Global sites or databases, you acknowledge that you agree to and are subject to the following terms and conditions . If you do not fully agree to these terms, you may not access or otherwise use our sites. You should read through all the Terms carefully as well as our home exchange guide . The Terms constitute a legally binding agreement between you and Global. 

YOU MAY NOT USE THE HOME EXCHANGE  SERVICES ON GLOBAL IF YOU ARE UNDER THE AGE OF 18 OR YOU ARE NOT ABLE TO FORM LEGALLY BINDING CONTRACTS, OR IF YOUR MEMBERSHIP HAS BEEN SUSPENDED BY US. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE REGISTERING FOR THE SERVICE. BY REGISTERING WITH GLOBAL, YOU BECOME A MEMBER (A "MEMBER"), AND YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT FOR AS LONG AS YOU CONTINUE TO BE A MEMBER.

PLEASE BE ADVISED THAT WE ARE NOT A PARTY TO ANY HOME EXCHANGE, BED AND BREAKFAST, HOSPITALITY OR RENTAL TRANSACTION.  We do not own nor can we contract for any home exchange, bed and breakfast, hospitality or vacation rental property listed on Global.  Instead, Global acts as a venue to allow a member of Global on any of our sites to offer for exchange, either simultaneous or non simultaneous, bed and breakfast accommodation, hospitality either free or paying, a home for rent, referred to as a vacation rental,  in a variety of pricing formats, a specific vacation rental property to potential renters (each visitor (traveler) and collectively with a member). We are not involved in the actual transaction between travelers and members or members and other members.  As a result, the quality, safety or legality of the properties advertised, the truth or accuracy of the listings (including the content and photos thereof), the ability of members to exchange homes or rent vacation property or the ability of travelers to pay for vacation rental properties are solely the responsibility of the users. 

Global  Services

• Global  is only responsible for the publishing of listings on Global Home Exchange and Global Pacific Vacation Homes    Global  is not responsible for listings that are published by members that have chosen multi home exchange listings on our home exchange partner sites.
• Global relies on the integrity and responsibility of the listing parties.
• Global  does not verify the existence or content of any property and does not guarantee that members will arrange a home exchange of any kind. Global is not responsible for the accuracy of the home listings or the actions of members, and claims no responsibility for the accuracy, content, or availability of information accessed or linked to through use of this service. 
• Members and users of all Global  services take sole responsibility for any and all agreements reached through use of this site.

Although we do charge a fee to members to list their home exchanges and advertise their bed and breakfast, hospitality or vacation rental properties on Global, we do not charge travelers to access any Global site and research listings or information.  Accordingly, we grant users a limited, revocable, non-exclusive license to access Global to, as applicable, list a home exchange or advertise bed and breakfast, hospitality and vacation rental properties and/or research, view or make legitimate inquiries to members regarding their interest in particular home exchange property, bed and breakfast accommodation, hospitality or vacation rental property for their personal use, all in accordance with these terms.  Any other use of Global is expressly prohibited. Importantly, this license does not include any right of collection, aggregation, copying, duplication, display or derivative use of Global nor any right of use of data mining, robots, spiders or similar data gathering and extraction tools without our prior written permission; provided, however, that a limited exception from the foregoing exclusion is provided to general purpose internet search engines and non-commercial public archives that use tools to gather information for the sole purpose of displaying hyperlinks to Global, provided they each do so from a stable IP address or range of IP addresses using an easily identifiable agent. General purpose internet search engine does not include a website or search engine or other service that provide classified listings or home exchange property, bed and breakfast, hospitality, rental advertisements, or any subset of the same, or which is in the business of providing these services.

Global is not responsible for the accuracy of information supplied by the Home Exchange, Vacation Rental, Bed and Breakfast or Hospitality Property Owner.  We  have not personally visited each property that is advertised.  User verification on the Internet is difficult and we cannot and do not confirm each user's purported identity.  The Property Owner will assume full liability for any information listed in their ad created on Global. Global  will not be responsible for any claim between the property owner and any renter, home exchanger or hospitality, bed and breakfast guest. 

Property Owners are encouraged to be as accurate as possible with information in their ad.  It is the responsibility of the Property Owner to preview all ads created by Global on their behalf, and have any inaccuracies corrected as soon as possible. We reserve the right to cancel any advertisement at any time the owner is proven to misrepresent the property advertised, in any way. 

Global is not involved in any transaction between the renter, exchanger or guest of hospitality, B&B, home exchange and the property owner. All rentals exchanges, hospitality and B&B's will be handled directly between the renter/exchanger/guest and property owner.

You are responsible for conducting your own investigation regarding any and all claims made by our vacation rental, B&B, hospitality or home exchange advertisers and by visitors or members that inquire about your exchange, rental, hospitality or bed and breakfast listing.

None of the information contained on any Global website is warranted by any party. You assume all liability for use of any information you find on the Global Home Exchange  Global Pacific Vacation Homes  web site and databases. We assume no responsibility and in no way warrant the accuracy of the home exchange, vacation rental, hospitality or bed and breakfast home listings (advertisements) contained on  Global.
 
Home Exchangers, vacation renters and those seeking hospitality or bed and breakfast accommodations establish their own agreement between parties. 

Global  does not participate in negotiating the terms of any home exchange, vacation rental, hospitality or bed and breakfast agreement.  Global is not responsible in any way if a vacation rental, bed and breakfast, hospitality or home swap agreement is cancelled once it is agreed to by the two parties.  For anyone participating in a vacation rental, bed and breakfast or hospitality agreement, be aware of scams, never wire money, never agree to send a cashiers check.  

As a Global member and site user

I will accurately describe my home and exchange or rental in my listing and in all correspondence. This includes an accurate description of the type and number of rooms. Any photos posted must be of the property offered for exchange or rent, house sitting, hospitality exchange or bed and breakfast, unless specifically indicated otherwise.

I will promptly respond to all members home exchange inquiries, with a courteous reply. I understand that I do not have to accept a home exchange request. 

I will not wire money for any vacation transaction, whether it is for a deposit, rent, return of overpayment or other monetary transaction for any accommodation including but not limited to a rental, house sitting, bed and breakfast, hospitality service or home exchange.  I will not deal with any vacation transaction (home exchange, vacation rental, bed and breakfast, hospitality, house sitting or other vacation transactions that requires me to wire money. Wiring money for vacation transactions is a scam.

I will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through this service, other than the posting of a home for exchange or rent./bed and breakfast shall not contain any type of advertising or solicitation other than an offer to exchange or rent in accordance with the terms of this site. No inquiries or responses between members shall contain any type of advertising or solicitation other than discussions relating to the exchange or rental of a member’s home in accordance herewith.

I will leave my house in a clean and sanitary condition for my exchange partner

I will treat other members and their property with courtesy and respect. I will treat my exchange partner's home and belongings as I would treat my own, and expect them to do the same. I will leave their home in as good or better condition than I found it.

I will notify my exchange partner or renter of any damage and offer to replace, repair or pay for same.

I will honor all obligations I make relative to the exchange or rental. Canceling or otherwise changing the dates of the exchange will only be under the most compelling circumstances. Understanding that my exchange partner has made plans and reservations based on my commitment to the exchange, if I am forced to cancel or change the exchange, I will make every effort to otherwise accommodate or find accommodations for my exchange partner.

I will not provide false or misleading information to Global or its members.

I will not use Global to violate any applicable law.

I will not upload or transmit any files that contain viruses, corrupted files, Trojan horses, malicious code, or any other similar software or programs that may harm the operation of another's computer or gain otherwise unauthorized access to the computer.

I will not post discriminatory content or send any content or engage in any conduct that subjects Global to any threat of civil or criminal penalties.

I am responsible for conducting my own investigation regarding any and all claims made by prospective exchangers, renters or vacation property owners or agents.

I assume all liability for use of any information I find on Global or our partner or affiliate web sites.

I understand that the operators of the Global  assume no responsibility and in no way warrant the accuracy of the information contained in any of the pages published here.

I have the authority to enter into this agreement, to post my listing and to offer it for exchange or rent.

I am responsible for investigating and adhering to all local regulations including, but not limited to, permits, licenses, occupancy taxes, zoning, rules and restrictions applicable to co-ops, condominiums and other common interest developments, and safety compliance.]

New membership via vouchers

Global may offer vouchers to members  in order to build membership. The Global member may choose to give away or sell each voucher to facilitate new membership.  Global is not responsible for any expense by any member to distribute for free or sell these vouchers.  Each member who chooses to distribute or sell memberships shall do so at their own risk.  The member who chooses to accept the vouchers is solely responsible for all expenses, taxes, licenses, fees, legal action resulting from the distribution or selling of vouchers.  As Global is not directly involved in any monetary transaction between a member seller and the purchaser of a voucher they will not be responsible for any refund, charge back or other fees .  

We caution any buyer of a Global membership who does so outside of the Global join page, to never wire money for any purchase.

Global may contain links and pointers to other Internet sites, resources, and affiliate partners web sites. Links to and from Global to other third-party sites and Global Home Exchange partner sites, maintained by third parties, do not constitute an endorsement by us of any third-party sites or the contents thereof.
 
Spamming
 

Global does not participate in or tolerate the sending of Unsolicited Commercial Email (SPAM) Global  reserves the right to cancel (without refund) any member that mentions Global  or any of its websites or associated (partner) websites, URLs, or any associated Global  email address in any SPAM e-mail message. Global  reserves the right to cancel (without refund) any member that uses Global Home Exchange to send any solicitations other than personal exchange inquiries or replies.

Global reserves the right to make changes to membership fees and listing options.  We do not issue refunds for any membership type.  We do not automatically bill members once their listing expires,  Members are sent a renewal reminder and they can choose to continue by resubmitting payment.
 
Global reserves the right to reject or edit any vacation rental, hospitality, bed and breakfast or home exchange offer submitted at its discretion. Once material has been submitted, edited and posted on any Global web site, it becomes the property of Global Home and its affiliated Web sites and databases and may not be copied without written permission.

If an active Global Home Exchange member moves, they may transfer their Global Home Exchange listing to their new property free of charge for the duration of their chosen listing time.

Global Home Exchange reserves the right to cancel any Membership for any reason, including misuse of the site, any action we feel compromises the security of the site, any action that adversely affects other Members or their property, or any action we feel is detrimental to Global Home Exchange. If any information provided by a member is found to be grossly misrepresented, or should the member's listing(s) or actions be in violation of any law or any provision of this agreement, Global Home Exchange reserves the right to remove, at its discretion, the members' listing(s) at any time, and/or to terminate the member's access to the Web site, without refund. Global Home Exchange listings run on an annual basis, unless otherwise stated.  No refunds or partial refunds will be offered.

Right of Member to Terminate

Members may terminate their Global Home Exchange listings or accounts at any time by contacting Global. Refunds will not be given when members terminate their listings or accounts..
